Terms Of Service (TOS)

1. GENERAL AGREEMENT Welcome to Humgrarte. By accessing our website (www.humgrarte.com) and purchasing artworks, you agree to be bound by the following Terms of Sale. These terms govern all transactions between Humgrarte (the "Gallery") and the buyer (the "Client"). If you do not agree with these terms, please refrain from using our services.

2. PRICING AND PAYMENT All prices listed on Humgrarte are in United States Dollars (USD). We accept major credit cards, PayPal, and wire transfers for high-value transactions. The Gallery reserves the right to update prices at any time without prior notice. The purchase is only confirmed once full payment has been successfully processed and cleared. For security and fraud prevention, the Gallery may request additional identity verification for first-time buyers or high-value acquisitions before shipping the artwork.

3. AUTHENTICITY GUARANTEE Humgrarte guarantees the authenticity of every artwork sold. All original artworks are accompanied by a physical Certificate of Authenticity (COA), signed by the artist or an authorized Gallery representative, detailing the work's provenance, medium, and dimensions.

4. SHIPPING, CRATING, AND HANDLING We ship globally from Bogotá, Colombia. Due to the delicate and high-value nature of contemporary art, standard shipping protocols do not apply.

Crating & Packaging: All artworks are professionally packed. Large-scale canvases and fragile pieces are shipped in custom-built wooden crates to ensure maximum protection.

Lead Times: Please allow 7 to 15 business days for professional crating and export documentation processing before the artwork is dispatched.

Delivery: We partner with specialized fine art couriers and trusted international carriers (e.g., FedEx, DHL). Once shipped, the Client will receive a tracking number. A direct signature is required upon delivery.

5. CUSTOMS, DUTIES, AND IMPORT TAXES (CRITICAL FOR INTERNATIONAL BUYERS) For clients purchasing outside of Colombia (including the United States), the buyer is the Importer of Record and is solely responsible for any customs duties, import taxes, or brokerage fees levied by the destination country's government. Humgrarte does not collect these fees at checkout, nor can we estimate them, as they vary by jurisdiction. Customs clearance procedures may cause delays beyond our original delivery estimates.

6. ALL SALES FINAL & RETURNS POLICY Given the logistical complexity and risks associated with shipping fine art internationally, all sales are final. We do not accept returns, exchanges, or order cancellations due to a "change of mind" or buyer's remorse.

Damages in Transit: If an artwork arrives damaged, the Client must notify the Gallery within 48 hours of delivery at [Insert Email Address]. The Client must retain all original packaging (including crates) and provide detailed photographic evidence of both the damaged packaging and the artwork. Failure to report damage within this timeframe or discarding the packaging will void any insurance claim and the possibility of a refund or replacement.

7. INTELLECTUAL PROPERTY AND COPYRIGHT Purchasing an artwork transfers the physical ownership of the piece to the Client, but it does not transfer the copyright. The artist retains all copyrights and reproduction rights to the artwork. The Client may not reproduce, distribute, or use the image of the artwork for commercial purposes without explicit, written permission from the artist and Humgrarte.

8. LIMITATION OF LIABILITY While Humgrarte strives to display artwork colors and textures as accurately as possible on our website, we cannot guarantee that your monitor's display will be completely accurate. Minor variations between the digital image and the physical piece do not constitute a defect.
